1. Acceptance of Terms

By accessing and using FunnelPlayground ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

FunnelPlayground is an AI-powered design inspiration platform that provides:

• AI-generated marketing funnel page mockups and designs
• Visual inspiration for landing pages, sales pages, and complete marketing funnels
• Gallery and organization tools for managing your funnel designs
• Multiple funnel templates including Product Launch, Lead Magnet, Webinar, Sales Funnels, and more
• Email and advertisement design templates (Pro users)
• Whiteboard organization features (Pro users)

Our Service generates visual mockups for design inspiration purposes. We do not provide actual code or functional websites—only visual design concepts and mockups.

3. User Accounts

3.1 Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

We offer two account types:

• Free Account: 1 funnel per month, basic funnel types, gallery view
• Pro Account: 30 funnels per month, all funnel types, email & ad designs, unlimited page regeneration, whiteboard organization

4. Subscription and Payment

4.1 Pricing

Pro subscriptions are available on a monthly ($8/month) or annual ($80/year) basis. Prices are subject to change with 30 days notice to existing subscribers.

4.2 Billing

Subscriptions automatically renew unless cancelled. You will be billed in advance on a recurring basis (monthly or annually, depending on your plan). Payment is processed through Stripe.

4.3 Refund Policy

We offer a 14-day money-back guarantee for Pro subscriptions. If you're not satisfied within 14 days of your initial purchase or renewal, contact us for a full refund. After 14 days, no refunds will be issued for partial subscription periods.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to Pro features until the end of your current billing period. After that, your account will revert to a Free account.

5. Intellectual Property Rights

5.1 Generated Designs

You retain all rights to the designs and mockups generated through FunnelPlayground. You may use these designs commercially, for client projects, or for any lawful purpose without attribution.

5.2 Service Ownership

FunnelPlayground and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Use automated systems (bots, scrapers) to access the Service without permission
• Resell, redistribute, or share your account access with others
• Reverse engineer or attempt to extract source code from the Service
• Generate designs that violate third-party intellectual property rights
• Use the Service to create misleading, fraudulent, or harmful content

7. Service Limitations

7.1 Usage Limits

Free accounts are limited to 1 funnel per month. Pro accounts are limited to 30 funnels per month. These limits reset on the first day of each calendar month.

7.2 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time.

7.3 AI-Generated Content

Designs are AI-generated and may vary in quality. We do not guarantee specific results or that generated designs will meet your requirements. Users should review all generated content before use.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times. We do not warrant the accuracy, completeness, or reliability of any content generated by the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
